Welcome to Serendipity Unboxed! Serendipity Unboxed is operated by Prestige Worldwide Supply LLC. The terms “we,” “us,” and “our” refer to Prestige Worldwide Supply LLC, doing business as Serendipity Unboxed.
We operate this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you access or use the Services.
Please read these Terms carefully. They contain important information regarding your legal rights and obligations, including provisions concerning mystery-box purchases, product condition, final sales, warranty disclaimers, and limitations of liability.
By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you are the age of majority and have consented to allow your minor dependents to use the Services on devices that you own, purchase, or manage.
To use certain portions of the Services, including purchasing products, you may be asked to provide information such as your name, email address, billing information, payment information, and shipping information.
You represent and warrant that all information you provide is accurate, current, and complete and that you have all rights necessary to provide such information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account. You may not transfer, sell, assign, or license your account to another person.
SECTION 2 – OUR PRODUCTS AND MYSTERY BOXES
Serendipity Unboxed sells curated mystery boxes containing merchandise selected by us. By purchasing a mystery box, you understand and acknowledge that the specific contents of your box may not be disclosed before purchase and will vary from box to box.
Products included in our boxes may be sourced from liquidation, overstock, shelf pulls, customer returns, closeouts, wholesale inventory, or other secondary-market sources.
As a result, products and/or their packaging may show signs of handling or wear and may have cosmetic imperfections, damaged or missing packaging, missing parts or accessories, or other defects.
Unless expressly stated otherwise in the applicable product listing, individual items are not guaranteed to be new, complete, functional, or free from damage.
Product photographs, videos, livestreams, previous unboxings, advertisements, promotional materials, social-media posts, and examples shown through our Services are provided for illustrative or promotional purposes unless we expressly state that a particular item is included in a specific purchase.
The appearance of a product in such content does not guarantee that the same product, brand, category, quantity, assortment, or condition will be included in any particular mystery box.
Unless expressly stated in the applicable product listing, we do not guarantee any particular product, brand, category, assortment, quantity, retail value, resale value, market value, or potential profit from the contents of a mystery box.
We make reasonable efforts to represent our products accurately. However, colors and product appearance may vary depending on your device, display settings, lighting, packaging, and merchandise condition.
All product descriptions and offerings are subject to change without notice. We reserve the right to discontinue any product or limit quantities offered to any person, geographic region, or jurisdiction.
SECTION 3 – ORDERS, PURCHASE ACKNOWLEDGMENT AND FINAL SALES
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline an order for any lawful reason at our discretion.
An order is not accepted until we confirm acceptance and successfully process payment.
Please review your order carefully before submitting it. Because orders may enter processing shortly after being placed, we may be unable to accommodate cancellation or modification requests after an order has been accepted.
If we decline, modify, or cancel an order, we will attempt to notify you using the email address, billing address, telephone number, or other contact information provided with your order.
ALL SALES ARE FINAL. NO RETURNS, REFUNDS, OR EXCHANGES.
By completing your purchase, you acknowledge and agree to these Terms of Service, our Refund Policy, and applicable product disclosures.
By purchasing a mystery box, you specifically acknowledge that you are purchasing the box as offered rather than selecting each individual item contained within it.
You understand and accept the inherent variability of mystery-box and liquidation merchandise, including differences in products, brands, categories, assortment, packaging, cosmetic condition, completeness, functionality, and value.
Dissatisfaction with the particular contents of a box, product preference, packaging condition, cosmetic condition, missing packaging, missing parts or accessories, product defects, functionality, perceived value, or market value does not by itself entitle a purchaser to a return, refund, or exchange.
Purchases are additionally subject to our Refund Policy.
SECTION 4 – PRICES, VALUES AND BILLING
Prices, discounts, and promotions are subject to change without notice.
The price charged for a product will be the price in effect when the order is placed and will be reflected in the applicable order confirmation.
Unless expressly stated otherwise, posted prices do not include applicable taxes, shipping, handling, customs, duties, or import charges.
Prices offered through our Services may differ from prices offered by physical retailers, online retailers, marketplaces, manufacturers, or other third parties.
Any manufacturer’s suggested retail price (“MSRP”), retail price, original price, comparable value, estimated value, or similar pricing or value information displayed or discussed through our Services, social-media accounts, livestreams, videos, advertisements, or promotional materials is provided for informational and comparative purposes only.
Such amounts do not constitute a guarantee that an item is currently offered or regularly sold for that amount by any particular retailer or marketplace. Actual selling prices may vary substantially based on retailer, promotions, location, product condition, availability, demand, seasonality, and other factors.
We do not guarantee the current market value or resale value of any product or mystery box. We do not guarantee that a purchaser will be able to resell a product, recover the purchase price of a mystery box, or earn any particular amount of revenue or profit.
From time to time, we may offer promotions governed by additional terms and conditions. If promotional terms conflict with these Terms regarding the specific promotion, the promotional terms will govern that promotion.
You agree to provide current, complete, and accurate purchase, payment, and account information.
You represent and warrant that any payment information you provide is accurate, that you are authorized to use the applicable payment method, and that charges incurred by you will be honored by your payment provider.
You agree to pay all charges associated with your purchase, including applicable shipping, handling, and taxes.
SECTION 5 – SHIPPING AND DELIVERY
Shipping and delivery dates provided through the Services are estimates only and are not guaranteed.
Delivery may be affected by carrier operations, weather, customs processing, holidays, address issues, natural disasters, and other circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate shipping address when placing an order.
Additional shipping charges resulting from an incorrect or incomplete address, refused shipment, unsuccessful delivery, or package returned to us may be the customer’s responsibility.
Once an order has been transferred to the shipping carrier, delivery is subject to the carrier’s operations and procedures.
If a shipment is lost or materially damaged during transit, please contact us so that we can determine whether a carrier claim or other appropriate remedy is available.
Damage to external shipping packaging does not necessarily indicate damage to the merchandise inside and does not independently create a right to a refund, return, or exchange.

Our Services, including trademarks, brands, text, displays, images, graphics, videos, audio, logos, designs, product descriptions, and the selection and arrangement thereof, are owned by us, our affiliates, or our licensors and are protected by applicable U.S. and international intellectual-property laws.
These Terms permit you to use the Services for your personal, non-commercial use.
Except as permitted by applicable law, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material from the Services without our prior written consent.
Nothing in these Terms grants you any license or other rights under any patent, trademark, copyright, or other intellectual property belonging to us, Shopify, or any third party except as expressly stated.
Serendipity Unboxed names, logos, product names, service names, designs, and slogans are trademarks or other intellectual property of their respective owners. Shopify’s names, logos, product and service names, designs, and slogans are trademarks of Shopify or its affiliates.
All other trademarks appearing through the Services remain the property of their respective owners.
SECTION 7 – OPTIONAL TOOLS
We may provide access to tools or services offered by third parties that we do not monitor or control.
You acknowledge that access to such tools may be provided “as is” and “as available” without warranties, representations, or endorsements from us.
Your use of optional third-party tools is at your own risk and discretion. You are responsible for reviewing and agreeing to the applicable third party’s terms and policies.
We may introduce new features, tools, or resources through the Services. Such features will be considered part of the Services and subject to these Terms.

The Services may contain materials, links, or functionality provided or operated by third parties.
We are not responsible for examining or evaluating the content, accuracy, security, policies, products, or services of third-party websites.
If you leave our Services to access a third-party website or service, you do so at your own discretion and risk.
We are not responsible for harm or damages related to your access to or use of third-party websites or your purchase or use of third-party products, services, resources, or content.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
Our online store is powered by Shopify, which provides technology enabling us to offer the Services.
However, purchases made from Serendipity Unboxed are transactions directly between you and Prestige Worldwide Supply LLC, doing business as Serendipity Unboxed.
Shopify is not the seller of our products and, to the extent permitted by applicable law, is not responsible for the products sold by us or for injuries, damages, losses, or disputes arising from transactions between you and us.
SECTION 10 – PRIVACY POLICY
Personal information collected through the Services is subject to our Privacy Policy.
Certain personal information may also be processed by Shopify in accordance with Shopify’s applicable privacy practices.
Because Shopify hosts our online store, information submitted through the Services may be transmitted to Shopify and other service providers, including providers located outside your state or country, as necessary to operate the Services.

If you submit, upload, post, email, or otherwise provide ideas, suggestions, feedback, reviews, proposals, photographs, videos, or other content relating to our Services (“Feedback”), you grant us a worldwide, perpetual, sublicensable, transferable, royalty-free license to use, reproduce, modify, publish, distribute, display, and otherwise use such Feedback for lawful purposes, including operating, improving, and promoting the Services.
You represent that you own or have sufficient rights to submit such Feedback and that your Feedback does not violate applicable law or the rights of any third party.
You are responsible for the Feedback you submit and its accuracy.

Occasionally, information available through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, values, promotions, shipping charges, transit times, availability, or other information.
We reserve the right to correct errors, inaccuracies, or omissions and to update information or cancel affected orders when appropriate, including after an order has been submitted, subject to applicable law.

Automated systems, bots, agents, scrapers, artificial-intelligence systems, or other software accessing the Services must comply with applicable technical restrictions, instructions, and laws.
You may not use automated systems to circumvent CAPTCHAs, security controls, access restrictions, rate limits, robot-exclusion mechanisms, or other measures intended to regulate automated access to the Services.
We reserve the right to restrict, suspend, or prohibit automated access to the Services at any time.

We may terminate or suspend your access to the Services, or any portion thereof, if we reasonably determine that you have violated these Terms, engaged in fraudulent or unlawful activity, abused the Services, or otherwise created a risk of harm or liability to us, our customers, Shopify, or another party.
You remain responsible for all amounts properly due through the effective date of termination.
Any provisions that by their nature should survive termination will remain in effect, including provisions relating to Intellectual Property, Feedback, Product and Purchase Acknowledgments, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law, and other accrued rights and obligations.
SECTION 16 – DISCLAIMER OF WARRANTIES
The information presented through the Services is provided for general informational purposes. Although we make reasonable efforts to provide accurate information, we do not warrant that all information available through the Services will always be accurate, complete, current, or error-free.
You acknowledge the nature of the merchandise described in Section 2, including the possibility that mystery boxes may contain liquidation, overstock, shelf-pull, customer-return, closeout, wholesale, or other secondary-market merchandise.
EXCEPT AS EXPRESSLY STATED BY US AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE.
Some jurisdictions do not permit certain warranty exclusions or limitations. Accordingly, some of the exclusions above may not apply to you.
SECTION 17 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PRESTIGE WORLDWIDE SUPPLY LLC, DOING BUSINESS AS SERENDIPITY UNBOXED, AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES, INCLUDING LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOST SAVINGS, LOSS OF DATA, OR SIMILAR DAMAGES.
This limitation applies regardless of whether the alleged liability arises under contract, tort, negligence, strict liability, or another legal theory and regardless of whether we were advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability to the extent such liability cannot lawfully be excluded or limited.
SECTION 18 – INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Prestige Worldwide Supply LLC, doing business as Serendipity Unboxed, and our affiliates, members, managers, officers, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, losses, costs, and reasonable attorneys’ fees arising from or relating to:
(a) your material breach of these Terms;
(b) your violation of applicable law or the rights of another person; or
(c) your misuse of the Services or products purchased through the Services.
We reserve the right to participate in or control the defense of an indemnifiable claim to the extent permitted by applicable law. You agree to reasonably cooperate in the defense of such claims.
SECTION 19 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law.
Any unenforceable portion will be severed or limited as necessary, and the remaining provisions of these Terms will remain in full force and effect.
SECTION 20 – WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, applicable product disclosures, and any other policies or rules expressly incorporated by reference, constitute the agreement between you and us regarding your use of the Services and supersede prior or contemporaneous communications concerning the same subject matter.
SECTION 21 – ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control, or other lawful business transaction, subject to applicable law.

These Terms and any separate agreements through which we provide the Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-laws principles.
To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought in a court of competent jurisdiction serving the Florida county in which Prestige Worldwide Supply LLC maintains its principal place of business.
The parties consent to the personal jurisdiction and venue of such courts, subject to any rights or venue requirements that cannot lawfully be waived.
